Appeals
A bad result in Housing Court or a trial court is not always the end. Arthur handles appeals to the Massachusetts Appeals Court and the Supreme Judicial Court, and was the prevailing attorney in Davis v. Comerford (SJC 2019) on use and occupancy in eviction appeals, and in Comerford v. Davis, also in the SJC.
We handle
- Appeals from eviction judgments, including motions to waive or reduce the appeal bond and use and occupancy payments
- Motions to stay an eviction while an appeal is pending
- Civil appeals in housing, discrimination and property cases
- Defending a favorable judgment when the other side appeals
The clock is short. In an eviction case, the notice of appeal is generally due 10 days after judgment (G.L. c. 239, § 5). In most other civil cases it is due within 30 days (Mass. R. A. P. 4).
