Adverse Possession and Tree Law
Disputes between neighbors over land and trees can be costly and personal. Massachusetts law has specific rules for both, and a few of them carry serious damages.
We handle
- Adverse possession claims and defenses. A person who openly and continuously uses land as their own for 20 years may gain title (G.L. c. 260, § 21).
- Prescriptive easements over driveways, paths and shared access (G.L. c. 187, § 2)
- Boundary line disputes, in the Land Court and Superior Court
- Tree cutting and damage. Anyone who cuts or destroys trees on another person’s land without permission can owe up to three times the damage (G.L. c. 242, § 7).
- Overhanging branches, roots and dead trees that threaten a neighboring home
